Sky Italia HeadquartersSky Italia has said that under the law it is
the Lazio court that will have to decide whether the current advertising
limit for pay-TV operators is valid.
The European Court of Justice has said that making a distinction between
pay and free-to-air broadcasts is not necessarily a violation of
European law.
“It is for the national court to decide whether it is legitimate to have
a lower ceiling on pay-TV operator and Sky is confident that the court
in Lazio will welcome our reasoning,” the broadcaster said.
The Court of Justice, despite having said the differentiation is not
unlawful, regards it as a matter for national courts to decide whether
the current rules constitute a restriction on the freedom to provide
services.
